Thank you for choosing Mixed Colours Cocktail Bars! Please read these Terms and Conditions carefully before using our services. Mixed Colours accepts no variation of these terms & conditions unless agreed in advance in writing.
These Terms and Conditions constitute a legal agreement between you (the "Client") and Mixed Colours Ltd. ("Mixed Colours") for the provision of pop-up cocktail bar services at your event. By using our services, you agree to be bound by these Terms and Conditions.
1. DEPOSITS
1.1: ’Deposit’ is the amount of money payable to Mixed Colours Cocktail Bars to guarantee the booking.
1.2: Deposits are transferrable (subject to availability) but non-refundable.
1.3: We require a 25% or £250 deposit (whichever is higher) to secure the booking.
1.4: Your booking date is only secure once the deposit has been received.
2. PAYMENTS
2.1: Payments can be made via Invoice, Bank Transfer or Card Online. For any online card payments we charge a 2% administration fee.
2.2: Your remaining balance is due 14 days before your event date.
2.3: If full payment is not received by the event date, we will be unable to provide our services and any deposits pre-paid will be non-refundable.
2.4: All payments are inclusive of VAT.
3. CANCELLATIONS
3.1: We reserve the right to cancel your event within 14 days prior and issue you a full refund at our discretion. We will only ever do this under exceptional circumstances.
3.2: In the event of cancellation by the client, the client forfeits the non-refundable deposit. The client has the option to transfer the booking to a new date subject to availability. Additional cancellation fees may apply based on the proximity to the event date.
3.3: Any changes to the event details, such as the date, time, or location, must be communicated to Mixed Colours at least 14 days before the event. Mixed Colours will make reasonable efforts to accommodate changes, but cannot guarantee availability.
3.4: If Mixed Colours is unable to provide the agreed-upon services due to unforeseen circumstances such as equipment failure or illness, we will make reasonable efforts to find a suitable replacement. If a replacement cannot be found, we will refund any payments made by the client.
3.5: Mixed Colours will not be liable for any delay or failure to provide services due to causes beyond our control, including but not limited to natural disasters, power outages, or labour strikes.
4. REFUNDS
4.1: No refunds will be issued for any unserved drinks (PAYG Bar) or absent guests (Open Bar).
4.2: No refunds will be issued for late running events unless the sole fault of Mixed Colours Cocktail Bars.
4.3: Please allow 5-7 working days for refunds to reach your nominated bank account.
5. QUOTES & BOOKINGS
5.1: Quotes are valid for 30 days. Dates are not reserved upon receiving a quote.
5.2: All booking dates are offered on a first come first save basis.
5.3: We will not alter booking times for late running events. On-the-day booking extensions are granted at our discretion.
5.4: Downgrading a package will only be possible if communicated to us in writing at least 30 days before your event. Packages can only be downgraded to a maximum of 20% of the initial booking price and not below the minimum spend for that day.
5.4: Booking start and end times cannot be adjusted within 12 hours unless under exceptional circumstances. Your event time cannot be adjusted by any more than 2 hours either earlier or later than the original start and end times.
5.5: We ask that the client thoroughly checks through the booking confirmation to ensure that the venue address, mobile contact, times and date are correct. We cannot be held accountable if our bartenders are late and cannot contact the client to confirm.
5.6: When hiring a service that provides alcohol, you must be over 18 years of age to book this service.
5.7: All bookings are subject to availability.
5.8: Any and all discount codes will need to be mentioned upon receiving a quote. No discounts will be applied after our 14 day no cancellation period.
6. PRICE GUIDE
6.1: Open Bar: Unlimited drinks and our full menu. Priced per person for every guest in attendance.
6.2: Credit Bar: Set a credit limit at the bar. Drinks prices apply. Top up at any time or combine with a cash bar.
6.3: Cash Bar: All drinks are charged to the guest. A deposit is still required and will be refunded upon completion of the event once the minimum spend is met. If the minimum spend is not met the purchaser is required to pay the difference, which will be deducted from the deposit. If a difference still remains this will be invoiced to the client and will be expected to be paid in a timely manner.
6.4: Other: Any other packages quoted by Mixed Colours are subject to an agreement made between us and the client. This will be communicated in writing and visible on your final quote.
7. EXTRAS
7.1: Custom Menu: Custom menu desires are required by the client no later than 28 days prior to your event. We will not be liable for inadequate menu design if this timeframe is not adhered to.
7.2: Custom Bar: Custom Bar desires are required by the client no later than 28 days prior to your event. We will not be liable for inadequate bar design if this timeframe is not adhered to.
7.3: Create Your Own Menu: CYO Menu desires are required by the client no later than 28 days prior to your event. We will not be liable for inadequate bar design if this timeframe is not adhered to.
7.4: Beer & Wine Selection: Beer & Wine are provided in our open bar and gold bar packages. They will be adequately stocked for your event. Please inform us of any particularly popular requests so we can accommodate this. On rare occasions we may run out of stock on a popular selection.
7.5: Bespoke Drinks Selection: Bespoke Drinks selections are provided as and charged by the bottle at trade price. They will be adequately stocked for your event. Please inform us of any particularly popular requests so we can accommodate this. On rare occasions we may run out of stock on a popular selection. Availability is subject to our discretion upon booking enquiry.
7.6: Mocktails Only: No alcohol is brought onsite in this case. We will not add externally supplied alcohol to our mocktails.
8. ACCESS
8.1: Adequate parking is required for all events and must be provided by the client. Registrations can be provided if required.
8.2: We do not require use of an access lift however any events that are not on the ground floor, we strongly advise an access lift to speed up setup. We will not be liable for late setup if appropriate means for access are not provided.
8.3: The Client is responsible for ensuring that the event location meets the requirements of the pop-up cocktail bar service, including adequate power supply if lighting is desired, access to a water supply and space for set up.
9. BARTENDERS
9.1: The bartender(s) will provide service for the agreed service hours from their start time until the end time, as dictated by your booking confirmation.
9.2: Bartenders are recommended and allocated based on the size of your event. This will be visible to you in your quote so make sure to choose a package that best suits the footfall you expect at the bar. Extra bartenders are available for purchase in our extras section.
9.3: We will not he held liable for slower service than usual if the amount of bartenders booked with your event is inappropriate for the capacity.
9.4: Our bartender(s) appreciate when provided with adequate food and snacks for long running events. Please notify us if this is not possible so we can arrange refreshments.
9.5: We do not tolerate verbal or physical abuse to any of our staff, and we reserve the right to abandon service and leave an event if we feel that our team are put in an uncomfortable or dangerous situation. No refunds will be given in the case of this arising.
10. SERVICE
10.1: We have a strict 18+ policy on serving alcohol and will not serve any minor directly under any circumstances. Challenge 25 - Anyone appearing under the age of 25 may be asked for I.D and will be refused service with failure to provide.
10.2: Our Open Bar package requires guests to finish their current drink before we will serve another at our discretion.
10.3: We have the right to refuse service to any guest who appears to be too intoxicated, rude or suspicious.
10.4: We will not be held liable for anyone consuming alcohol against their knowledge.
10.5: Mixed colours does not promote excessive or irresponsible drinking.
10.6: Mixed Colours will set up and dismantle the bar area as required and provide all necessary bar equipment, ingredients, alcohol, garnishes, ice and plasticware.
10.7: We do aim to provide our bars in a perfect state, however with working several events general wear and tear, light scratches and marks may appear on your hired bar. We do repair and replace these minor areas regularly.
11. COMPLAINTS
11.1: We treat all complaints about our service, either in advance, during or after the event seriously. If you are not happy with the service whilst the party is happening, please speak with a member of staff on site and see if the problem can be rectified. If this is difficult or unrealistic to do, please call the out of hours mobile number and we will do everything we can to resolve the problem.
11.2: For complaints made post-event we ask that video or photographic evidence be supplied where possible in order to assist your claim. When it is found that Mixed Colours is at fault, we will recompense with a discount or free service for a future event, for the party organiser or a nominated person.
12. LICENSING
12.1: Mixed Colours is not responsible for acquiring temporary event notices for paid bar events unless required to in writing and therefore is also not responsible for any breaches of licenses outside of Mixed Colours’ control.
12.2: Mixed Colours only partakes in licensed trade. There will be a personal license holder present with every event. License details can be provided upon request.
13. INSURANCE & LIABILITY
13.1: Mixed Colours has public liability insurance for all events. Copies of our latest insurance documents are available upon request. We strongly recommend that you understand why it is important to book with a fully insured company.
13.2: The Client is responsible for ensuring that their guests behave in a responsible and safe manner.
13.3: The Client is responsible for guests welfare on the premises.
14. LOSS & DAMAGES
14.1: Mixed Colours is not liable for any loss, damage, or injury arising from the provision of the pop-up cocktail bar services, except for liability arising from our negligence or breach of these Terms and Conditions.
14.2: The Client agrees to indemnify and hold harmless Mixed Colours and its employees from any claims, damages, or liabilities arising from the Client's breach of these Terms and Conditions or the Client's use of Mixed Colours' pop-up cocktail bar services.
14.3: In the event of any damages or losses, incurred to Mixed Colours during the provision of the mobile cocktail bar services, the Company reserves the right to incur additional charges to cover this upon completion of the booking.
15. MENU & INGREDIENTS
15.1: Allergen information for all cocktails is available on our menu or simply by asking our bartenders on the day. We will not be held responsible for negligence in this category.
15.2: Mixed Colours will provide a menu of cocktails to be served at the event. The Client is responsible for informing Mixed Colours of any dietary restrictions or allergies of their guests. Mixed Colours will provide all necessary ingredients unless stated otherwise for the agreed-upon menu.
15.3: We always make sure to provide adequate stock appropriate to your package. In the case of bespoke drinks selections please let us know if a particular drink is popular with your guests. We may on rare occasions run out of stock on some selections.
These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which Mixed Colours is based. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
The above conditions are subject to change at the discretion of Mixed Colours in part or in whole for one or more of its clients where the company has grounds deemed necessary.
